  • Marriage is a solemn institution and a big step in anyone's life. A marriage performed specifically for a Visa application is not usually considered to be a genuine marriage. 
  • Celebrants are not permitted to offer you immigration advice, you need to get that from the department, a lawyer, or a licensed immigration agent.

Having said that, you do not need to have a Marriage Certificate for a Partner Visa application, you need only lodge a Notice of Intended Marriage (NOIM) and secure a letter of confirmation from the Celebrant with whom you have lodged the NOIM,  1-18 months before the eventual genuine marriage. Fees apply. 

The immigration department will assess your application to determine if it is to be a genuine marriage or simply a sham marriage specifically for Visa purposes as you appear to suggest.  If not a genuine marriage, the Visa may be rejected, an existing Visa may be cancelled, the marriage could be declared void, and the parties could be prosecuted with one or both deported if not Australian citizens.

  • A marriage certificate cannot be issued without a Marriage Ceremony.

A ceremony can be reduced to only a few minutes with just two witnesses present and vows exchanged; however if the marriage was shown to be a sham, the celebrant could also be reprimanded or prosecuted.

My advice is, to be honest, to be genuine, and to only marry if marriage is truly your intent.

Hi there,

There is no option legally to get marriage certificates without a ceremony. For the marriage to be legal,-

  -the Notice of Intent to Marry must be completed 1 month prior to the ceremony

  -The Monitum must be said

  -you must each say the legal vows

  -you must have two witnesses over the age of 18

  -you must sign the 3 marriage certificates.

Just because it is called a ceremony doesn't mean it is particularly involved. I can do a legals only ceremony which needn't take more than 5 minutes to complete all of the above. It can also take place wherever you like. I can even come to your house and perform it in your kitchen.

This would be a 'Legals Only ' Ceremony .Notice of Intended Marriage needs to be given to Celebrant one month before proposed Ceremony.Legal wording , signing of legal documentation and two witnesses over age of 18 are required as part of legal ceremony.Celebrant will register your marriage.

Hi, Yes you can get a legal certificate for your partner Visa application, although as with any legal process it does take a little time. Firstly, you need to complete a Notice of Intended Marriage Form, 1 month before a wedding date. Legal words need to be said, the couple & celebrant, in front of 2 adult witnesses, documents to be signed, then the celebrant lodges your marriage with Registrar of Births, Deaths & Marriages. If they apply for the legal certificate at the same time as lodgement you will receive your certificate of marriage by express postage within 4-5weeks. (current registration turnaround time in Vic)

Hi, this would be a legals only ceremony, which takes 5 to 10 minutes, and the celebrant says the legally required wording, you repeat after them what is legally required, sign your marriage certificate and voila, you're married!  If interested my legal only ceremonies are $295 (conditions apply).

There are certain legal aspects of a wedding which must be adhered to. First you must give 1 months notice to the celebrant who is performing your ceremony.

Yes there has to be a "ceremony" of sorts. You must have 2 witnesses to hear your legal vows. These people do not have to know you but they must be over the age of 18.

Then the celebrant must say who they are, that they are a celebrant authorised by law to marry you, then the monitum is said. This states what the marriage act is.

The vows between you both are the legal vows that ensure you are married and you are aware of what marriage means. 

Then the legal documents can be signed and witnessed. There are 2 marriage certificates to be signed, these are the official ones to go to Births, Deaths and Marriages then you and your witnesses sign the legal Commemorative Certificate that you keep. This wouldn't be suitable as legal proof of marriage you would have to apply for the official one from BDM. Your celebrant can do this and the time frame (in NSW) is between 7-10 days. Firstly, marriage in Australia is the union of two people for life.

If you're getting married just for visa purposes, then no.

However if you need to be married to your chosen partner, the marriage still needs to be legal.

It can be between you, your partner and two witnesses over 18.

You must sign documentation to validate your marriage.
