Can a tourist marry in Australia?

hi, i just want to ask if me and my girlfriend can marry in Australia i am a Filipino Citizen and she is a Canadian Citizen. our problem is she cannot provide her birth certificate. we will only be there as a tourist cause i will be coming from Philippines and she will be coming from Canada, we just want to get married legally. is there any other options we can provide besides from Birth Certificate as a requirement to marry and if so what should we do first ? thank you..

Yes, both of you as tourists can get married in Australia, whether you are here for 6 months or less, there is no residency requirements. The only real requirement is that you are free to marry and that both of you are at least 18 years of age. To travel you both need a passport, and it is obvious that you both have one and even though you do not have birth certificates you would have had to produce them to get your passports so you do not need a birth certificate. If your passport document is in a language other than English it needs to be translated into English by a certified translater, and there is a few other things to comply with: that you are not related to each other, if one or both of you were previously married you need to show proof of divorce, or death, and that you are not married to someone else at the moment.

Hi, That all sounds like a great plan. As you have already had explained, Australia is open to anyone who is legal to marry being able to celebrate their wedding here and your visa is irrelevant. And your fiance's passport is adequate proof of identity and birthplace.

You and your fiance can decide where in Australia you would like to marry and through this website make contact with a celebrant there. The pre-wedding paperwork (Notice of Intended Marriage or NOIM) can be done in an online or skype approach to begin the paperwork. It can be witnessed by one of you going to an Australian Embassy and lodging it by email with your celebrant in Australia. 

So get planning and decide where and when you'd like to get married!

Firstly congratulation on your pending special day.

Secondly, I have personally conducted several Destination Weddings for overseas couples who came to Australia just to get married, similar to your girlfriend and you, and can advise that the process can be quite simple with the right celebrant.

Echoing what Susan & Rosemary have already advised, anyone can come to Australia and get married, on the proviso that you met all the legal requirement and adhere to the timeline for each of the procedures. I would like to enhance their advice by adding that:

1) If either of you are already in Australia, you can lodge the NOIM with an Australian Civil celebrant first without needing both parties to be present, or

2) if both of you are outside of Australia, either of you can go to the Australian Embassy in your country to get the completed NOIM witnessed and dated, and then contact an Australian celebrant of your choice.

Yes, you can marry in Australia if you are on a Tourist Visa.  Your Fiance can use her Canadian Passport and Driver's Licence.  Rosemary has indicated below the conditions for legal marriage in Australia.  You must lodge a Notice of Intended Marriage one calendar month ahead of your wedding date.  You can download the Notice of Intended Marriage form from the Attorney General's Department (or I can send you one), complete it, have it witnessed by any of the authorities listed on p4 of the Notice.  The completed and witnessed Notice,  your Passports and Driver's Licences can then be scanned and emailed to your chosen Celebrant.  When you meet your Celebrant you must show him/her your original Notice and your  documentation Ie passports and drivers' licences. If you aren't together one month ahead of your wedding date, one of you can lodge the Notice but all information has to be completed and witnessed before the wedding can take place.  I hope this is helpful.  Susan Tomasz Marriage Celebrant

Anyone can come to Australia and get married. However it does not give you the right to live in Australia permanently.  Here is what you will need to do:

1. Complete the Notice of Intended Marriage Form and lodge it with your Celebrant of choice a minimum of one month in advance of your planned date of wedding. Or a maximum of 18 months in advance.

2.  If you do not have a Birth Certificate, you can use your Pass Port and your Drivers Licence and Proff of Age Card if you have one. will need to be sighted by the Celebrant.  Only original documents required for sighting by the Celebrant.

3. You must not already have been married.

4. You must not be related to each other

5.  You need to be a minimum of 18 years of age to marry in Australia.

6.  If either of you have been divorced or are a widow then documents such as original copy of your Divorce Certificatte or an orginal document such as a Death Certificate of previous spose will need to be sighted by the Celebrant. 

7.  Please bring the above documents to show the celebrant for sighting.
