Can I submit a NOIM to the registry before my divorce is finalised?

My divorce (joint application)is currently booked in to be heard August 7th and we are planning to be married on September 22nd. Can we lodge a NOIM to make sure we meet the 1-month requirement whilst the divorce is being processed and show it finalised before the wedding day?

No. This is done after the wedding which cannot occur until the divorce is approved by the Court.

The NOIM is not sent to Registry until after the ceremony. in the meantime, the Celebrant holds it and, once you supply the Divorce Certificate, then the rest of the paperwork and ceremony can go ahead.

Yes, your celebrant can help you
there are many things that change between the NOIM and the solemnization.
Divorce status is one of them

Yes, you can lodge a NOIM to your celebrant or your chosen officiant now, they will note "divorce pending". A divorce becomes effective one month & one day after the court hearing. So as long as your divorce is heard on the 7th August it should be finalised and effective before your new wedding date. xo Deb

Yes - the marital status will say "Divorce pending".  Then you can marry when the divorce become absolute/effective - whic is usually one month plus a day AFTER the divorce hearing (unless both parties to the divorce agree to magistrate bringing tha effectiva date forward).

Yes.  If there is a hold up with the divorce you may need to extend the wedding date.  It is more important to get the NOIM lodged one month before hand and then hope the divorce is finalised before the wedding.

You're correct in that your Notice of Intended Marriage (NOIM) must be lodged with your chosen marriage celebrant at least one calendar month prior to your intended wedding date. In relation to your specific situation with a pending divorce, it is possible to submit your NOIM and proceed with your wedding as long as you provide your divorce certificate prior to the wedding day.

You have to Submit the NOIM to the celebrant not to the registery. However the celebrant will need to check the divorice certificate before he or she can proceed with the paper work

You only need to lodge the NOIM to the celebrant and yes you can lodge it as long as you have the decree absolute prior to the wedding. The celebrant will need to sight the original document before they can marry you
