Parties<\/h2>\n<p><span style=\"font-weight: 400;\">This Agreement is entered into between:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Easy Weddings Travel Pty Ltd<\/b><span style=\"font-weight: 400;\"> (ABN 25 6879 3375) of 18 Miles Street, Mulgrave VIC (hereafter referred to as \u201cEasy Weddings\u201d or \u201cEW\u201d); and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The party identified as the <\/span><b>Client<\/b><span style=\"font-weight: 400;\"> (hereafter referred to as \u201cthe Client\u201d), being the person(s) engaging Easy Weddings to provide Destination Wedding services.<\/span><\/li>\n<\/ul>\n<h3>2. Definitions<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Site<\/b><span style=\"font-weight: 400;\">: The website located at<\/span><a href=\"https:\/\/www.easyweddings.com.au\"><span style=\"font-weight: 400;\">https:\/\/www.easyweddings.com.au<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Destination Wedding Package<\/b><span style=\"font-weight: 400;\">: A bundled arrangement of venues and supplier services as set out in the Client\u2019s written quotation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Easy Weddings:<\/b><span style=\"font-weight: 400;\"> Officers, employees, agents, or representatives of Easy Weddings Travel Pty Ltd.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Customer\/Client:<\/b><span style=\"font-weight: 400;\"> A person using the Services for the purpose of a Destination Wedding\/Event.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Venue\/Service Provider<\/b><span style=\"font-weight: 400;\">: The venue, hotel, or supplier engaged to provide services for the Client\u2019s wedding.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Destination Buy Rate<\/b><span style=\"font-weight: 400;\">: A fixed Australian Dollar (AUD) rate applied by Easy Weddings to convert supplier pricing from local currency into a secured AUD amount.<\/span><\/li>\n<\/ul>\n<h3>3. Background<\/h3>\n<p><span style=\"font-weight: 400;\">i. Easy Weddings offers Destination Wedding Packages to couples that include venues, suppliers, and event coordination.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> ii. The Client wishes to engage Easy Weddings to plan and manage their wedding in accordance with the quotation provided.<\/span><\/p>\n<h3>4. Booking and Payment<\/h3>\n<h5>4.1 Planning Fee<\/h5>\n<p><span style=\"font-weight: 400;\">A non-refundable <\/span><b>$500 deposit<\/b><span style=\"font-weight: 400;\"> is payable on booking. This confirms Easy Weddings\u2019 services and initiates venue availability checks.<\/span><\/p>\n<h5>4.2 Cooling-Off Period<\/h5>\n<p><span style=\"font-weight: 400;\">The Client has a <\/span><b>3-day cooling-off period<\/b><span style=\"font-weight: 400;\"> following payment of the $500 deposit. Cancellations must be submitted by <\/span><b>email<\/b><span style=\"font-weight: 400;\"> to destination@easyweddings.com.au. Written email acknowledgement from Easy Weddings confirms validity of the cancellation.<\/span><\/p>\n<h5>4.3 Venue Confirmation<\/h5>\n<p><span style=\"font-weight: 400;\">Easy Weddings checks and secures venue availability prior to confirming a booking. Venue availability is guaranteed only if the <\/span><b>venue deposit is paid within the required time frame<\/b><span style=\"font-weight: 400;\">. If unpaid, Easy Weddings cannot guarantee the requested date.<\/span><\/p>\n<h5>4.4 Payment Schedule<\/h5>\n<p><span style=\"font-weight: 400;\">The following payment schedule applies unless otherwise specified in the quotation:<\/span><\/p>\n<div style=\"width: 100%; Supplier Engagement<\/h3>\n<h5>5.1 Supplier Terms<\/h5>\n<p><span style=\"font-weight: 400;\">Suppliers may request clients to accept their own terms and conditions. Easy Weddings reviews these and will notify the Client if any terms materially differ.<\/span><\/p>\n<h5>5.2 Supplier Guarantee<\/h5>\n<p><span style=\"font-weight: 400;\">Easy Weddings guarantees supplier replacement up to <\/span><b>seven (7) days prior to the wedding<\/b><span style=\"font-weight: 400;\">. After this point, Easy Weddings will make best efforts but cannot guarantee availability.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If no suitable supplier can be sourced, Easy Weddings will <\/span><b>refund the Client in full for the affected supplier cost<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Easy Weddings is not liable for service performance but will liaise with suppliers to ensure Minimum Standards of Service are met.<\/span><\/li>\n<\/ul>\n<h5>5.3 Payment Terms and Package Adjustments<\/h5>\n<p>All payments follow the agreed payment schedule confirmed by Easy Weddings via Qwilr or written email approval.<\/p>\n<p>Once a Destination Wedding Package is confirmed, the Client may not reduce the total package value by more than twenty-five percent (25%) of the confirmed amount.<\/p>\n<p>Requests to make reductions beyond this threshold are at Easy Weddings\u2019 sole discretion and may require the Client to either:<\/p>\n<ul>\n<li>Maintain payment of the originally confirmed package value; or<\/li>\n<li>Replace the reduced value with equivalent services or add-ons (e.g. upgraded inclusions or additional guests).<\/li>\n<\/ul>\n<h5>5.4 Supplier Additions After Confirmation<\/h5>\n<p>After the Client has confirmed their package via signed approval, additional suppliers or services may be requested in writing via email.<\/p>\n<p>Any approved additions will be incorporated into the Client\u2019s existing payment plan, and Easy Weddings will confirm revised instalment amounts and due dates in writing prior to implementation.<\/p>\n<h3>6. Currency and Pricing<\/h3>\n<h5>6.1 Destination Buy Rate<\/h5>\n<p>Easy Weddings applies a <strong>Destination Buy Rate<\/strong> to convert supplier invoices from local currency into AUD. This provides:<\/p>\n<ul>\n<li>A fixed AUD price, locked at quotation<\/li>\n<li>Protection from exchange rate swings<\/li>\n<li>Rates generally much more favourable than retail bank or credit card conversions<\/li>\n<li>Rates that cover all international transaction fees.<\/li>\n<\/ul>\n<p>The Destination Buy Rate provides the Customer with a fixed AUD price, locked at quotation, protecting the Customer from foreign exchange fluctuations and international transaction fees.<\/p>\n<p>The fixed AUD price is subject to these Terms and Conditions and excludes any new or increased government taxes, levies, duties or statutory charges introduced or changed after the date of quotation or booking which apply to the Destination Wedding Services.<\/p>\n<h5>6.2 Security Bonds<\/h5>\n<p><span style=\"font-weight: 400;\">Certain venues (e.g. private villas) require a <\/span><b>cash bond payable directly by the Client on arrival<\/b><span style=\"font-weight: 400;\">. Easy Weddings does not charge or retain administration fees in relation to venue bonds.<\/span><\/p>\n<h3>7. Cancellations<\/h3>\n<h5>7.1 By Client<\/h5>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The $500 planning deposit is always retained.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cancellations after the cooling-off period are subject to staged penalties as outlined in the Payment Schedule.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No refunds are provided if guest numbers reduce after the final payment date.<\/span><\/li>\n<\/ul>\n<h5>7.2 By Venue\/Supplier<\/h5>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the Client is late with payments or unresponsive, Easy Weddings may notify suppliers.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Suppliers may then cancel. Easy Weddings will notify the Client in writing before such action is taken.<\/span><\/li>\n<\/ul>\n<h5>7.3 Force Majeure<\/h5>\n<p><span style=\"font-weight: 400;\">If a Force Majeure (natural disasters, pandemics, political unrest) prevents the wedding from proceeding, Easy Weddings will make <\/span><b>best efforts to renegotiate a new date<\/b><span style=\"font-weight: 400;\"> on behalf of the Client. Service Failures<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Easy Weddings will <\/span><b>negotiate a fair settlement<\/b><span style=\"font-weight: 400;\"> with venues\/suppliers on behalf of the Client in the event of a service failure.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Client\u2019s remedy for venue\/supplier negligence lies with the supplier, but Easy Weddings will act as the Client\u2019s representative in all communications.<\/span><\/li>\n<\/ul>\n<h3>9. Liability and Indemnity<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Easy Weddings\u2019 liability is limited to the value of the <\/span><b>planning fees paid by the Client<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Clients indemnify Easy Weddings against third-party claims except where caused by Easy Weddings\u2019 proven negligence.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Clients are responsible for any damage caused by themselves or their guests.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Couples are encouraged to review all inclusions carefully and consider obtaining wedding or travel insurance to protect against unexpected risks, including cancellations, supplier issues, or guest-related incidents.<\/b><\/li>\n<\/ul>\n<h3>10. Data Privacy<\/h3>\n<p><span style=\"font-weight: 400;\">Easy Weddings collects and stores Client information solely for the purpose of managing wedding bookings.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">We do not share Client data with third parties except as required to complete bookings with venues, suppliers, and accommodation providers. All data is managed in accordance with Australian privacy law.<\/span><\/p>\n<h3>11. General<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This Agreement represents the entire understanding between Easy Weddings and the Client.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Governing law: The laws of Victoria, Australia.<\/span><\/li>\n<\/ul>\n<h3>12. Government Taxes, Levies and Statutory Charges<\/h3>\n<p>The price quoted by Easy Weddings is based on the taxes, government charges, levies, duties and other statutory charges applicable to the Destination Wedding Services at the time the quotation is issued.<\/p>\n<p>If, after the date of quotation or booking, any government, regulatory authority or other competent authority introduces a new tax, levy, duty or statutory charge, or increases or changes an existing tax, levy, duty or statutory charge, which applies to any part of the Destination Wedding Services, the resulting additional amount will be payable by the Customer.<\/p>\n<p>This applies whether the new or increased charge is imposed directly on the Customer or is required to be collected, remitted or passed on by Easy Weddings, a Hotel\/Venue, accommodation provider, supplier or other service provider.<\/p>\n<p>Any such amount is separate from the original quoted price and does not constitute an increase in Easy Weddings&#8217; fees or margin. Easy Weddings will notify the Customer of the additional amount as soon as reasonably practicable after being notified of the applicable change.<\/p>\n<p>Where reasonably available, Easy Weddings will provide the Customer with details of the applicable government tax, levy, duty or statutory charge.<\/p>\n<p>For the avoidance of doubt, any reference in these Terms and Conditions, a quotation, proposal or booking confirmation to a &#8220;fixed&#8221;, &#8220;locked&#8221; or confirmed price does not include increases resulting from the introduction, amendment or increase of government taxes, levies, duties or other statutory charges after the date of quotation or booking.<\/p>\n<h3>13.
